3:00 pm – 4:00 pm Can JMB and MC Committee Members Be Sued Personally? Understanding Personal Liability in Strata Management
About this talk
Committee members of Joint Management Bodies (JMBs) and Management Corporations (MCs) make decisions on a host of matters including maintenance, finances, contractor appointments and by-law enforcement. Disputes frequently arise when parcel owners disagree with those decisions and when allegations of wrongdoing or conflicts of interest are made.
This talk explores the extent to which JMC and MC members may be held personally liable for actions taken in the course of managing a strata development. Based on the Strata Management Act 2013, Malaysian case law, and practical examples, this session examines committee members’ legal protections, personal liability risks, and avenues for parcel owners to challenge management conduct.
Participants will better understand the legal relationships between owners, management bodies, and committee members, as well as the practical implications of committee service.
The talk will be delivered over video conference using Zoom.us. You can either view the talk from your web browser or download the Zoom app.
