Jeremy Balang

Jeremy Balang graduated with honours from Cardiff University in 2016 and completed his Certificate in Legal Practice in 2017.

Jeremy was admitted as an Advocate and Solicitor of the High Court of Malaya in 2018. He joined MahWengKwai & Associates in 2022.

Jeremy is a litigation lawyer whose primary area of practice is medical law, with a particular focus on medical and dental negligence claims. He regularly advises and acts in complex claims involving hospitals, specialist doctors, healthcare practitioners, and professional indemnity providers, and appears in matters across all tiers of the Malaysian courts.

Jeremy leads the firm’s Medical & Personal Injury Department, where he is involved in the strategic assessment and conduct of medical negligence claims, including claims arising from diagnostic failures, surgical and post-surgical complications, emergency care failures, maternal and infant injury, paediatric injury, and elderly care. His work includes advising on issues of hospital liability, vicarious liability, standards of care, consent, causation, and quantum, as well as cases involving treatment at Government, university, and private hospitals. He is closely involved in the strategic assessment of cases at an early stage, including the preparation of written legal opinions on the merits and prospects of potential claims, and advising clients on resolution, litigation risk, and when public determination is necessary.

He has acted for patients and their families, as well as for doctors, hospitals, and insurers, giving him a practical and balanced understanding of how medical negligence claims are assessed, defended, and resolved. Jeremy is frequently involved in matters where clients seek advice on whether an adverse outcome amounts to negligence, including cases where treatment is described as a “known complication” or where consent was obtained.

Jeremy has appeared as leading and junior counsel in trials and appellate proceedings, including matters before the Court of Appeal and the Federal Court of Malaysia. He also represents clients in proceedings before regulatory bodies, including the Malaysian Medical Council, and is a member of the Medico-Legal Society of Malaysia.

Jeremy also regularly speaks at conferences, professional forums, and educational events on medical law and medico-legal practice, and contributes commentary and analysis on developments in medical negligence litigation.

In addition to his medical law practice, Jeremy also handles personal injury claims, including motor vehicle accident claims and occupiers’ liability cases.

Medical Negligence

• Jeremy has acted for claimants with serious injuries and their families, including infants who suffered cerebral palsy and brain injuries, as well as adult patients, in medical negligence claims against the Government of Malaysia, university hospitals, private hospitals, and specialist doctors.
• His experience spans a broad range of medical specialities in the context of medical negligence claims, particularly those involving issues such as delayed or missed diagnosis, surgical and post-surgical complications, failures in monitoring or escalation of care, consent-related disputes, and hospital or institutional liability.
• This includes claims arising from treatment in anaesthesiology, obstetrics and gynaecology, general surgery, neurosurgery, orthopaedics, emergency medicine, radiology, aesthetic and cosmetic medicine, rehabilitation medicine, dermatology, dentistry, ophthalmology, ENT, endocrinology, urology, bariatric surgery, oncology, gastroenterology, nephrology, paediatrics, neonatology, cardiology, vascular surgery, psychiatry, plastic surgery, internal medicine, and rheumatology.
• Jeremy also acts as counsel to law firms representing clients who are victims of medical or dental negligence.

Medical Defence or Malpractice

• Jeremy has acted for doctors, hospitals, and their professional indemnity providers in respect of patient complaints and civil suits. He has also acted in matters involving disciplinary proceedings and complaints before the Malaysian Medical Council, representing both patients and healthcare practitioners.

Disciplinary Proceedings and MMC Complaints

• Jeremy has acted as counsel in cases involving the Malaysian Medical Council on behalf of patients (in respect of their complaints to the MMC) and healthcare practitioners (in respect of disciplinary proceedings before the MMC).

Personal Injury

• Jeremy represents victims of motor vehicle accidents in claims before the Sessions Court and the High Court, and has acted for individuals who suffered injuries arising from unsafe or hazardous premises (occupiers’ liability).
